The Council on Environmental Quality (CEQ) has issued new guidance directing federal departments and agencies to adopt a "CE-first" approach to environmental reviews under the National Environmental Policy Act (NEPA).
This framework standardizes how departments establish, revise, adopt, and apply categorical exclusions for actions that normally do not have significant environmental effects.
For the average citizen and local communities, this means infrastructure projects could see significantly faster approval timelines by avoiding excessive permitting burdens.
By allowing agencies to use a streamlined process instead of drafting comprehensive environmental analyses from scratch for qualifying actions, the regulatory pipeline moves much more efficiently.
This operational shift ultimately aims to lower the compliance costs associated with federal permitting and unleash economic growth.
Every federal department and agency that handles NEPA obligations will utilize these updated procedures to fulfill their environmental review requirements.
To assist with this government-wide transition, the CEQ launched digital tools, including the Categorical Exclusion Explorer database and the CE Works pilot platform, to digitize and track the application of these regulatory exemptions.
Furthermore, this guidance formally integrates the recent NEPA amendments established by the Fiscal Responsibility Act of 2023.
