Commerce Department Extends Application Deadline for Authorized IC Designer Status

The Department of Commerce's Bureau of Industry and Security (BIS) issued a final rule amending the Export Administration Regulations to extend the application deadline for entities seeking "approved integrated circuit (IC) designer" status.
The regulation extends the triggering date for authorized IC designer status by approximately eight months, shifting the deadline from April 13, 2026, to December 31, 2026.
This extension directly modifies Note 1 to Export Control Classification Number (ECCN) 3A090.a.
Under existing regulations, front-end fabricators and Outsource Semiconductor Assembly and Test (OSAT) companies face a presumption of denial when exporting or transferring certain advanced logic integrated circuits unless they obtain this approved status through the End-user Review Committee.
This administrative delay directly alters the compliance timeline for the semiconductor industry, preventing imminent export blockages for companies currently navigating the approval queue.
By pushing the deadline to the end of the year, the rule provides circuit designers additional time to compile and submit their applications, while simultaneously granting BIS the necessary bandwidth to process the influx of requests.
Furthermore, entities that submit their applications by the new December 31 deadline may operate as authorized IC designers for a 180-day grace period while their status is reviewed.
