DOJ Forces PayPal to Scrap DEI Fund in $30M Enforcement Action

On May 12, 2026, the Justice Department secured a settlement with PayPal Inc. to resolve a fair lending investigation into the company's investment practices.

The focus of the probe was PayPal's Economic Opportunity Fund, which the company launched in 2020 to direct investments toward black and minority-owned businesses.
Emboldened by a January 2025 executive order from the President that explicitly targeted Diversity, Equity, and Inclusion programs as incompatible with merit, the agency is now actively weaponizing federal civil rights statutes to dismantle corporate diversity initiatives.
The government determined the program was discriminatory.
According to the Department of Justice, the fund gave preference to businesses based on race, color, and national origin, but it was not established to remediate specific instances of past discrimination.
The consequences are immediate and expensive.
PayPal is now legally required to abandon criteria based on protected characteristics and launch a neutral Small Business Initiative.
As the core financial remedy, PayPal must waive processing fees for $1 billion in transactions.
This represents an approximate $30 million value given back to the market.

The relief is not universal.
The settlement strictly limits these fee waivers to eligible American small businesses that are veteran-owned, or engaged in the farming, manufacturing, or technology sectors.
This mandated redirection of capital fundamentally alters the American startup ecosystem, abruptly choking off dedicated funding pipelines for minority entrepreneurs while simultaneously subsidizing operational costs for rural, agricultural, and veteran markets.
The compliance oversight extends deep into PayPal's corporate structure.
The company must designate a dedicated director for the new initiative and conduct a formal needs assessment for American small businesses.
PayPal is also required to submit operational plans to the United States, execute employee training on the Equal Credit Opportunity Act, and deliver annual reports on the program's progress.
The Justice Department explicitly warned that American corporations face aggressive enforcement if they use race or national origin as a discriminatory factor against qualified Americans.
Consequently, corporate compliance costs will spike nationwide as legal departments scramble to rewrite their internal lending algorithms and investment frameworks to survive this new, aggressively race-neutral regulatory landscape.
